Moniker.com and Moniker Marketplace are owned and operated by Moniker Online Services, LLC (“Moniker”).  At Moniker, we take your privacy seriously. This Privacy Policy explains how we collect and use information about you as you utilize any Moniker services. Our Privacy Policy is subject to change, so we encourage you to visit this page frequently to review our practices. By using services provided by Moniker, you indicate that you agree to the collection and use of your information by Moniker as outlined in this Privacy Policy.

Why We Collect Information
First and foremost, Moniker collects information to allow us to provide and improve our services and to present you with information and features that we believe will interest you. We also use your information to measure our success and performance. For example, aggregate information gives us an idea of the number of visitors we attract and how they navigate our site.

Personal Information We Collect
Any personal information that is collected by us is provided by you strictly on a voluntary basis. We may receive personal information from you in a number of ways, depending on the Moniker service you are using and your choices while using our services. Depending upon the nature of the service being provided, we may ask you for, and you may choose to send to us, your name, e-mail address, physical address or other personal information necessary to complete a transaction, provide services to you, enter a contest or take a survey.  For example, personal information is requested when you register to be a user of our services. Use of Personal Information
As noted above, unless you voluntarily provide personal information for a specific purpose, we do not collect personal information from you. If you choose to provide personal information, we use your personal information to provide you with particular services that you request. For instance, we may use your personal information to contact you about services that you have requested and to provide you with data about the services.  More specifically, when you provide us with your email address, we will use your e-mail information to send you outbid offer notices and notices regarding the closing of transactions. In addition, we may use your e-mail for other features requiring e-mail notifications.
We may also share your personal information with business partners who provide services you have requested. In these cases, we will provide only the information that is needed to perform the service. If you do not want Moniker to share your information in this way, you can simply choose not to sign up for the service in question. By providing your email address to Moniker, you expressly consent to receive emails from us.

In addition to the examples above, we may also use your personal information as otherwise specified in this Privacy Policy or in any other manner in which you may consent, including any such consent granted by you under any Terms and Conditions that govern the services you use.  When your consent is required for use of personal information that is not otherwise authorized by this Privacy Policy or the applicable Terms and Conditions for a service, we will seek to obtain your consent at the place where the information is collected either by an "opt-in" or "opt-out" method, or by other means (such as sending you an e-mail).

Moniker does not sell personal information to other companies. However, we will transfer personal information in connection with a sale or merger of Moniker or the division responsible for the services provided to you and we may share personal information with our corporate affiliates. We may also share your personal information with our technical consultants, third party auditors and other third parties who make our site available, enhance its functionality or provide associated services and/or who deal with you in processing your orders and/or delivering content, products, services and gifts and prizes. These third parties are not allowed to use personal information except for the purposes of providing the applicable services.

In addition, you acknowledge and agree that, Moniker may make available and use personal information or other information you provide or that we otherwise maintain, to public or private third parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to criminal and civil subpoenas and court orders that reasonably appear to be valid; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us; and (iv) to protect the rights, property, or safety of Moniker, our users, or others, whether during or after the term of your use of our service.

Our site and services are maintained in the United States of America. By using the site and/or services, you authorize the export of personal information to the USA and its storage and use as specified in this policy.

Aggregate Information We Collect and Use
In addition to personal information, we may also collect non-personally identifiable information, such as site pages viewed, browser type, computer information, cookies, clickstream data and other information. This aggregate information is analyzed and combined with similar aggregate information of other users. Such aggregate information is anonymous and does not identify any individual user. We may share aggregate information with our business partners and other third parties.

"Clickstream data" is a trail of electronic information that is left at each Web site you visit. This information can be collected and stored by a site's server. We may, for example, use clickstream data to tell us the type of computer and browsing software you use, the address of the site from which you linked to our site, how much time you spend on each page of our site, how you navigate throughout the site and how we may tailor our Web pages to better meet the needs of our users.

Supplementation of Information
In order for our site to perform properly and as necessary to perform or enhance our services, we may supplement the information we receive on this site with information from third party sources. For example, to determine if our customers qualify for credit, we may use their personal information to request a credit report. As another example, we may combine cookie data gathered on this site with cookie data from a third party in order to improve our services.

Other Web Sites

This type of collection or use of information is beyond Moniker's control and is not covered by this Privacy Policy. Publication Rights
In order to perform certain services on your behalf, we may need to publish certain information that you provide.  For example, you agree that Moniker shall have the right to publish the name of any domain name sold as well as the respective purchase price on our Website or in other places for reference purposes.
In addition, in order for us to comply with the current rules and policies for the domain name system, you hereby grant to Moniker the right to disclose to third parties through an interactive, publicly accessible registration database the following mandatory information that you are required to provide when registering or reserving a domain name:

  1. the domain name(s) registered by you;
  2. your name and mail address;
  3. the name(s), mail address(es), email address(es), voice telephone number and where available the fax number(s) of the technical and administrative contacts for your domain name(s);
  4. the Internet protocol numbers of the primary nameserver and secondary nameserver(s) for such domain name(s);
  5. the corresponding names of those nameservers;
  6. the original creation date of the registration; and
  7. the expiration date of the registration.

We, as are all accredited domain name registrars, are also required to make this information available in bulk form to third parties who agree not to use it to (a) allow, enable or otherwise support the transmission of mass unsolicited, commercial advertising or solicitations via e-mail (spam) or (b) enable high volume, automated, electronic processes that apply to our systems to register domain names.

You further acknowledge and agree that Moniker.com may make publicly available, or directly available to third parties, some or all of the information you provide, for purposes of inspection (such as through our WHOIS service) or for targeted marketing and other purposes as required or permitted by applicable laws. One of the ways that Moniker.com may make some or all of the information you provide available to the public or third parties is by way of bulk WHOIS data access provided to third parties who enter into a bulk WHOIS data access agreement with Moniker.com. Moniker.com reserves the right to discontinue providing bulk WHOIS data access to third parties.

Moniker may, from time to time, make chat rooms, forums, message boards, news groups and other community tools available to our users.  Please remember that any information that is disclosed in these areas becomes public information for other users to view and for Moniker to use.

Security
Moniker stores all data using industry standard security devices, such as firewalls and encryption protocols, to prevent against unauthorized access to our data. We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect. We have put in place policies to restrict access to your information by our employees.  However, Moniker cannot guaranty that your information will be protected from unauthorized access, and you assume such risk when you use our services.

Protection for Children
We have no intention of collecting personal information from children under the age of 13. When we become aware that personal information from a child under 13 has been collected without such child's parent or guardian's consent, we will use all reasonable efforts to delete such information from our database.
